1. Parties and acceptance
"Pomlet", "we", "us" and "our" refer to the operator of Pomlet. "User", "you" and "your" refer to any person or organization using the service. If you use Pomlet for an employer, school, customer, club or other organization, you represent that you have authority to bind that organization.
If you do not agree with these Terms, do not use Pomlet. Additional terms may apply to paid subscriptions, third-party services, promotions, beta features or custom agreements.
2. The Pomlet service
Pomlet lets users create quizzes and presentation elements, generate quiz drafts with AI, upload or import images, organize quizzes in personal or team spaces, host live games, enable self-paced solo play, embed quizzes in other websites or learning systems, and view reports.
We may improve, change, limit, suspend or discontinue features at any time. We try to keep Pomlet available and reliable, but we do not guarantee uninterrupted, error-free or permanent availability.
3. Accounts and security
Hosts and quiz creators need an account. Players can usually join a game with a PIN and a nickname without creating an account. You must provide accurate account information, keep credentials confidential and notify us promptly of unauthorized use.
You are responsible for all activity under your account, including quiz content, AI prompts, uploaded files, organization actions, subscriptions, seat changes, invitations and hosted games. We may refuse, suspend or terminate accounts that violate these Terms or create risk for Pomlet or others.
4. Organizations, admins and seats
Pomlet organizations allow teams to share quizzes, manage members and buy seats. Admins can invite members, assign roles and licenses, manage billing and access shared organization content. Creators may have more limited rights.
Organization admins are responsible for their members, invitations, billing choices, internal permissions and lawful use of Pomlet by their organization. Removing a member may remove that member's access to shared organization content, but it may not remove copies, exports, screenshots or information already viewed by others.
5. User content
"User Content" means anything you or your players submit, upload, generate, store, display or transmit through Pomlet, including quiz titles, descriptions, questions, answers, explanations, images, slide content, prompts, source URLs, extracted document text, player nicknames, answers, game results, reports and organization information.
You keep ownership of your User Content. You grant Pomlet a worldwide, non-exclusive, royalty-free license to host, process, copy, transmit, display, transform and otherwise use User Content as needed to operate, secure, improve and provide Pomlet, including generating quiz drafts, showing live games, serving embeds, storing reports, providing support and enforcing these Terms.
You represent and warrant that:
- you have all rights, permissions and legal bases needed to use the User Content;
- your User Content does not infringe intellectual property, privacy, publicity or other rights;
- your User Content complies with law and the Acceptable Use Policy;
- you will not submit confidential, personal, regulated or sensitive information unless you are authorized and accept the risks described in these Terms.
6. AI-assisted features and third-party AI providers
Pomlet may let you create quizzes from a topic, URL, document text or PDF. When you use AI features, you instruct Pomlet to send the relevant prompt, source material, extracted text and context to third-party AI providers, including OpenAI or successor providers, so they can process the request and return generated content.
The raw PDF file is intended to be read in your browser and not stored by Pomlet as the original file for AI generation. However, extracted text and prompts are transmitted to Pomlet and then to the AI provider, and the generated quiz output is stored in Pomlet like any other quiz until deleted.
Third-party AI providers operate their own systems, security controls, data retention controls, policies and legal terms. Pomlet does not control those independent systems. To the fullest extent permitted by law, Pomlet is not responsible for how an AI provider processes data after you choose to use an AI feature, except where Pomlet's responsibility cannot legally be excluded.
AI output may be inaccurate, incomplete, biased, offensive, unsafe, unsuitable, infringing or otherwise wrong. You must review, edit and validate every AI-generated question, answer, explanation, title, image query and cover choice before using it. AI output is not legal, medical, financial, educational compliance, safety or professional advice.
7. Public sharing, live games and embeds
Live games are shared by PIN or QR code. Anyone with the PIN may be able to join while the game is open. Players may see questions, answer choices, images, explanations, rankings and results depending on the game mode and settings.
Pomlet embeds are designed to be public, self-paced quiz experiences. If you copy or share an embed URL or iframe code, anyone with access to that URL or the page containing it may access the embedded quiz content, including correct answers where the embedded experience requires them. Do not embed confidential quizzes unless you are comfortable with that exposure.
8. Children, students and educational use
Pomlet may be used in classrooms and training environments. Account holders, schools, teachers, trainers and organizations are responsible for determining whether they need consent, parental authorization, school approval, a data processing agreement or other safeguards before using Pomlet with minors, students, employees or participants.
Players should not be asked to enter unnecessary personal information as nicknames or answers. Hosts are responsible for avoiding quizzes that expose sensitive student, employee, health, financial or confidential information.
9. Paid plans and billing
Paid plans, subscriptions, seats, renewals, cancellations, taxes, payment failures and refunds are governed by the Sales & Refund Terms. Payment processing is handled by a third-party payment provider. We do not store full card numbers.
10. Acceptable use
You must comply with the Acceptable Use Policy. You may not misuse Pomlet, interfere with the service, bypass limits, scrape, reverse engineer, attack, overload, resell unauthorized access, submit unlawful content or use Pomlet to harm others. We may remove content or restrict access when we reasonably believe there is a violation or risk.
11. Third-party services and content
Pomlet may integrate with third-party services such as AI providers, payment processors, email providers, image providers, authentication providers and infrastructure providers. Third-party services may be subject to their own terms and privacy policies. Pomlet is not responsible for third-party websites, services, content, decisions, outages or policies except where applicable law says otherwise.
12. Intellectual property and feedback
Pomlet owns the service, software, interface, design, brand, documentation and related intellectual property. These Terms do not transfer ownership of Pomlet to you. You may not copy, modify, distribute, sell, lease, decompile or create competing products from Pomlet except where law expressly allows it.
If you send feedback or suggestions, you grant Pomlet a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or compensation.
13. Disclaimers
Pomlet is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, statutory or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, availability, security and uninterrupted operation.
You are responsible for reviewing content, configuring games, testing embeds, managing access, backing up important information and deciding whether Pomlet is appropriate for your legal, educational, operational or compliance requirements.
14. Limitation of liability
To the fullest extent permitted by law, Pomlet will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, lost profits, lost revenue, lost data, business interruption, reputational harm, procurement of substitute services or damages arising from AI output, third-party providers, user content, embeds, live games, reports or unauthorized access.
To the fullest extent permitted by law, Pomlet's total liability for all claims relating to the service will not exceed the greater of CHF 100 or the amounts paid by you to Pomlet for the service in the three months before the event giving rise to the claim. This limitation does not exclude liability that cannot be excluded under applicable law.
15. Indemnity
To the fullest extent permitted by law, you will defend, indemnify and hold Pomlet harmless from claims, losses, liabilities, damages, costs and expenses arising from your User Content, your use of Pomlet, your breach of these Terms, your violation of law or third party rights, your use of AI features, your public sharing or embeds, or your organization's users and players.
16. Suspension and termination
You may stop using Pomlet at any time. We may suspend or terminate access, remove content, disable embeds, cancel games, limit features or close accounts if we believe it is necessary to protect Pomlet, users, players, third parties or legal compliance. Termination does not automatically entitle you to a refund unless required by law or the Sales & Refund Terms.
17. Governing law and disputes
Unless mandatory consumer protection rules require otherwise, these Terms are governed by the laws of Switzerland, without regard to conflict-of-law rules. Courts located in Switzerland will have jurisdiction, except where mandatory law gives you the right to bring claims elsewhere.
Before starting a formal dispute, you agree to contact legal@pomlet.com and give Pomlet a reasonable opportunity to resolve the issue.
18. Changes
We may update these Terms. Material changes will be communicated in a reasonable way, such as by updating this page, emailing account holders or showing an in-product notice. Continued use after changes take effect means you accept the updated Terms.
