Terms of Service

"Pomlet", "we", "us" and "our" refer to the operator of Pomlet. "User", "you" and "your" refer to any person or organization using the service. If you use Pomlet for an employer, school, customer, club or other organization, you represent that you have authority to bind that organization.

If you do not agree with these Terms, do not use Pomlet. Additional terms may apply to paid subscriptions, third-party services, promotions, beta features or custom agreements.

Pomlet lets users create interactive sessions, quizzes, presentation elements and collaborative whiteboards, generate quiz drafts with AI, upload or import images, organize content in personal or organization spaces, host live sessions, enable self-paced mode, share or embed content, and view reports.

We may improve, change, limit, suspend or discontinue features at any time. Pomlet takes reasonable security measures and tries to stay available and reliable, but no system is infallible: we do not guarantee an uninterrupted, error-free or incident-free service. Our commitments are obligations to use reasonable efforts, not guarantees of a result.

Hosts and content creators need an account. Participants can usually join a session with a PIN and nickname without creating an account. A whiteboard may accept guests by link or require an account, organization membership or invitation. You must provide accurate account information, keep credentials confidential and notify us promptly of unauthorized use.

Accounts and paid licences are assigned to individual users unless Pomlet expressly states otherwise. You may not share login credentials, use one account as a shared team login or bypass device, session, licence, plan or payment limits. Pomlet may require verification, revoke sessions, block new sign-ins, limit features or suspend access where account sharing or other abuse is suspected. Pomlet records devices and sessions for security and abuse prevention, and may show a warning when device usage in a billing period suggests account sharing.

You are responsible for all activity under your account, including session and whiteboard content, collaboration permissions, AI prompts, uploaded files, organization actions, subscriptions, licence changes, invitations and hosted sessions. We may refuse, suspend or terminate accounts that violate these Terms or create risk for Pomlet or others.

Each organization has one owner. Only the owner purchases licences and adjusts their number, manages the subscription, payment methods and invoices, and receives future financial emails. Ownership can be transferred to a member; the former owner becomes an admin. The subscription, saved payment method, legal billing details and historical invoices are preserved. Admins manage members, invitations, roles, licence assignments and shared content without billing access. Creators build and host content without member administration or billing access.

Each member uses their own account. A role does not automatically grant Pro: an assigned licence or personal Pro subscription is required. Personal Pro does not use an organization licence. The owner is responsible for billing decisions; admins are responsible for access they grant. Removing access does not erase copies or exports already made.

"User Content" means anything you or your players submit, upload, generate, store, display or transmit through Pomlet, including session and quiz titles, descriptions, questions, answers, explanations, images, slide content, whiteboard names, sticky notes, text, shapes, connectors, drawings, votes, prompts, source URLs, extracted document text, participant nicknames, contributions, results, reports, invitations, access roles and organization information.

You keep ownership of your User Content. You grant Pomlet a worldwide, non-exclusive, royalty-free licence to host, process, copy, transmit, display, transform and otherwise use User Content as needed to operate, secure, improve and provide Pomlet, including generating quiz drafts, delivering live sessions and real-time whiteboard collaboration, serving embeds, storing reports, providing support and enforcing these Terms.

You represent and warrant that:

• you have all rights, permissions and legal bases needed to use the User Content;
• your User Content does not infringe intellectual property, privacy, publicity or other rights;
• your User Content complies with law and the Acceptable Use Policy.

Pomlet is designed for usual facilitation content: questions, answers, ideas and nicknames. We recommend that you avoid entering particularly sensitive data (health data, identification numbers, bank details, critical trade secrets) and that you use nicknames where appropriate.

Pomlet may let you create quizzes from a topic, URL, document text or PDF. When you use AI generation inside the Pomlet application, you instruct Pomlet to send the relevant prompt, source material, extracted text and context to third-party AI providers via OpenRouter (an AI API gateway) and the underlying models/endpoints it routes to, so they can process the request and return generated content.

The raw PDF file is intended to be read in your browser and not stored by Pomlet as the original file for AI generation. However, extracted text and prompts are transmitted to Pomlet and then to the AI provider, and the generated quiz output is stored in Pomlet like any other quiz until deleted.

Pomlet configures OpenRouter calls to use only endpoints that declare Zero Data Retention (ZDR), so prompts and outputs are not retained after processing and are not used to train models on those endpoints. This depends on the policies and declarations of the underlying providers via OpenRouter. Pomlet does not guarantee that Zero Data Retention, non-retention or non-use for training will always be available, accurate or honored by every provider, endpoint or model. Provider policies may change without notice. By using AI features, you accept that risk and remain responsible for the content you submit.

Third-party AI providers operate their own systems, security controls, data retention controls, policies and legal terms. Pomlet does not control those independent systems. To the fullest extent permitted by law, Pomlet is not responsible for how an AI provider processes data after you choose to use an AI feature, except where Pomlet's responsibility cannot legally be excluded.

AI output may be inaccurate, incomplete, biased, offensive, unsafe, unsuitable, infringing or otherwise wrong. You must review, edit and validate every AI-generated question, answer, explanation, title, image query and cover choice before using it. AI output is not legal, medical, financial, educational compliance, safety or professional advice.

Pomlet connectors and plugins, including for ChatGPT, Claude, Codex and other compatible MCP clients, make Pomlet tools available through a third-party service. A Pomlet account and OAuth authorization are required to access your content. Sign in only on the designated Pomlet page: never send your password or tokens in a conversation. Before an AI assistant is connected through MCP, Pomlet's authorization screen shows the email address of the signed-in account, the space concerned (your personal space and, where applicable, the organization), the permissions requested and the domain the connection returns to. You can revoke the connection at any time from the MCP window in your account. Your account rights and the organization's rules still apply.

MCP access is included without an additional Pomlet charge, including for free accounts. Your Pomlet account's capabilities, storage, session and access limits still apply. When ChatGPT, Claude or another assistant drafts a quiz, it uses its own model and plan limits. Pomlet MCP tools store and manage the content received: they do not call OpenRouter or consume Pomlet's built-in AI-generation quota. Your assistant plan remains separate from your Pomlet account.

Authorized assistant actions run on your account. An edit, deletion, sharing change or session launch can have a real effect; review the content, recipients and scope before authorizing the action. The optional panel shows the quiz preview; it does not edit the quiz, create a session or save trial answers. Edits take place through the conversation or the full Pomlet editor. Sessions and participation links use Pomlet interfaces and their usual rules.

Review content proposed by the assistant, including correct answers and information about other people. Authorizing a connector does not permit uses for which you lack the necessary rights. You can revoke a connection in your Pomlet account; this blocks future access without undoing completed actions or deleting copies already held by the third-party service. That service's terms, privacy settings and limits also apply. Integration availability and presentation may change with the client used.

Live games are shared by PIN or QR code. Anyone with the PIN may be able to join while the game is open. Players may see questions, answer choices, images, explanations, rankings and results depending on the game mode and settings.

Whiteboards may be shared through a guest link, restricted to signed-in users, limited to an organization or opened to invited email addresses. Owners and admins control access roles, but anyone who receives an active guest link may be able to view or contribute according to its settings. Whiteboard content is persistent until it is deleted under the product's available controls.

Pomlet embeds are designed to be public, self-paced quiz experiences. If you copy or share an embed URL or iframe code, anyone with access to that URL or the page containing it may access the embedded quiz content, including correct answers where the embedded experience requires them. Do not embed confidential quizzes unless you are comfortable with that exposure.

Pomlet may be used in classrooms and training environments. Account holders, schools, teachers, trainers and organizations are responsible for determining whether they need consent, parental authorization, school approval or other safeguards before using Pomlet with minors, students, employees or participants. Pomlet’s commitments for participant data are set out in section 8a.

Players should not be asked to enter unnecessary personal information as nicknames or answers. Hosts are responsible for avoiding quizzes that expose sensitive student, employee, health, financial or confidential information.

When you use Pomlet with participants (a class, a team, guests…), you, the account holder, whether a person or an organization, decide why their data is collected: you are the controller. Pomlet (Switzerland) processes it on your behalf, as a processor. Pomlet commits to:

• process it only to provide the service as you use it;
• ensure that the people who have access to it keep it confidential;
• protect it with appropriate security measures;
• use only the providers listed in the Privacy Policy, where any change is announced;
• help you answer participants’ requests, with the product’s deletion and export tools or with support;
• delete it when you delete it or close your account, with backups expiring afterwards;
• notify you without undue delay of any data breach affecting it;
• provide, on request, the information needed to demonstrate compliance with these commitments.

These commitments are part of these Terms and apply automatically: no separate contract is needed. They are obligations to use reasonable efforts; Pomlet’s liability for them follows section 14 (Limitation of liability).

Paid plans, subscriptions, licences, renewals, cancellations, invoices, payment failures and refunds are governed by the Sales & Refund Terms. Payment processing is handled by a third-party payment provider. We do not store full card numbers.

You must comply with the Acceptable Use Policy. You may not misuse Pomlet, interfere with the service, bypass limits, scrape, reverse engineer, attack, overload, resell unauthorized access, submit unlawful content or use Pomlet to harm others. We may remove content or restrict access when we reasonably believe there is a violation or risk.

Pomlet relies on third-party providers, in particular for hosting, payment, email and AI, as well as for images and authentication. They are subject to their own terms and privacy policies. Within the limits of the law, Pomlet is not responsible for their failures, outages, decisions or policies, nor for third-party websites, services or content.

Pomlet owns the service, software, interface, design, brand, documentation and related intellectual property. These Terms do not transfer ownership of Pomlet to you. You may not copy, modify, distribute, sell, lease, decompile or create competing products from Pomlet except where law expressly allows it.

If you send feedback or suggestions, you grant Pomlet a perpetual, irrevocable, worldwide, royalty-free licence to use them without restriction or compensation.

Pomlet is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, statutory or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, availability, security and uninterrupted operation.

You are responsible for reviewing content, configuring games, testing embeds, managing access, backing up important information and deciding whether Pomlet is appropriate for your legal, educational, operational or compliance requirements.

Within the limits permitted by law, Pomlet is liable for direct damage only. Indirect damage is excluded, including loss of data, revenue or profit, business interruption and reputational harm.

Within the same limits, Pomlet’s total liability for all claims relating to the service is capped at the amounts you paid Pomlet for the service in the 12 months before the event giving rise to the claim.

These limits do not apply in case of wilful misconduct or gross negligence (art. 100 of the Swiss Code of Obligations). Nor do they restrict mandatory consumer rights, including those granted by European Union law.

To the fullest extent permitted by law, you will defend, indemnify and hold Pomlet harmless from claims, losses, liabilities, damages, costs and expenses arising from your User Content, your use of Pomlet, your breach of these Terms, your violation of law or third party rights, your use of AI features, your public sharing or embeds, or your organization's users and players.

You may stop using Pomlet at any time. We may suspend or terminate access, remove content, disable embeds, cancel games, limit features or close accounts if we believe it is necessary to protect Pomlet, users, players, third parties or legal compliance. Termination does not automatically entitle you to a refund unless required by law or the Sales & Refund Terms.

Unless mandatory consumer protection rules require otherwise, these Terms are governed by the laws of Switzerland, without regard to conflict-of-law rules. Courts located in Switzerland will have jurisdiction, except where mandatory law gives you the right to bring claims elsewhere.

Before starting a formal dispute, you agree to contact hello@pomlet.com and give Pomlet a reasonable opportunity to resolve the issue.

We may update these Terms. Material changes will be communicated in a reasonable way, such as by updating this page, emailing account holders or showing an in-product notice. Continued use after changes take effect means you accept the updated Terms.
